1. About these Terms
PatientUpdate.App is a product created and operated by Internet Marketing & Events Management Ltd, a limited company registered in the United Kingdom. In these Terms & Conditions ("Terms"), "we", "our" and "us" refer to Internet Marketing & Events Management Ltd trading as PatientUpdate.App (the "Service"). By accessing, creating an account, or otherwise using the Service you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. What we provide
PatientUpdate.App is a communication platform that lets a user (the "Patient" or "Account Holder") share personal updates about their hospital or care journey with people of their choosing via a shareable link. We provide the platform only. We are not a medical service, we do not provide medical advice, and we are not connected to any hospital, clinic or healthcare provider.
The platform is hosted on Lovable Cloud (built on Supabase), which acts as our data processor. A full list of processors and how we handle your personal data is set out in our Privacy Policy.
3. Your responsibilities for content and sharing
All information, updates, images, video, comments and any other content ("User Content") posted to the Service is created and controlled by you. You are solely responsible for:
- the accuracy, legality and appropriateness of your User Content;
- ensuring you have the right and permission to share any information about yourself or any other person;
- choosing who to share your journey link with and how widely it is distributed;
- keeping your account credentials secure.
You must not use the Service to post content that is unlawful, defamatory, harassing, misleading, or that infringes anyone's rights.
4. Shared links and privacy
Journey links are designed so that anyone with the link can view the updates without needing to sign in. This is a deliberate feature so that family and friends can access updates easily.
Once you share a journey link, you are choosing to make that content accessible to anyone who receives or forwards the link. We cannot control who a link is forwarded to. Accordingly, once a link has been shared by you, we are not responsible for the onward distribution, re-sharing, screenshotting or downstream privacy of that content. If you want to restrict access, do not share the link, or ask us to disable it.
5. No medical advice
The Service is not a medical device and does not provide medical advice, diagnosis or treatment. Nothing on PatientUpdate.App should be relied upon as a substitute for professional medical care. Always contact a qualified healthcare professional or the emergency services in a medical emergency.
6. Limitation of liability
To the maximum extent permitted by law, we provide the Service "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or secure against every conceivable threat. We are not liable for any loss, damage, distress or claim arising from:
- the content you or others post on the Service;
- how a shared journey link is distributed, viewed or re-shared;
- reliance on any information posted on the Service;
- temporary unavailability of the Service.
Nothing in these Terms limits liability that cannot be excluded under applicable law (for example, for death or personal injury caused by negligence, or fraud).
7. Data protection — UK & GDPR
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, and, where applicable, the EU General Data Protection Regulation (EU GDPR). This includes principles of lawfulness, fairness and transparency; purpose limitation; data minimisation; accuracy; storage limitation; and integrity and confidentiality.
You have the standard rights available to data subjects under UK and EU data protection law, including the right to access, rectify, erase, restrict or object to processing of your personal data, and the right to data portability. To exercise these rights, contact us at info@patientupdate.app.
Please remember that content you knowingly publish via a shared journey link is being made accessible by you to third parties. UK and EU data protection law does not remove your responsibility for the content you choose to share, and once shared you accept that we cannot control its onward distribution.
8. Account termination
You may stop using the Service at any time and request deletion of your account and associated content by emailing us. We may suspend or terminate accounts that breach these Terms or that we reasonably believe are being used to harm others.
9. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify users. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Governing law
These Terms and any dispute arising out of them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that if you are a consumer resident in another UK nation, you may also bring proceedings in that jurisdiction.
